EuroQuest LLC. reserves the right to change your hotel booking to one of at least comparable standard and to notify you of such change as soon as possible after it occurs. No compensation is payable for such changes. In extreme circumstances EuroQuest LLC. may be forced to cancel your booking in which case you will be notified of such change as soon as possible, a full and prompt refund will be made and EuroQuest LLC. will not be under any further liability to you or your party. EuroQuest LLC. endeavors to ensure that its discount vouchers are always redeemable, however we allow our supplier partners to change the terms of these vouchers or withdraw them without notice at any time. This rarely happens and whilst the discount should be available it cannot therefore be guaranteed.

Taxability and the appropriate tax rate vary greatly by location. EuroQuest LLC.s actual tax cost paid to the vendor may vary from the tax recovery charge, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel, automobile, etc. by our customer.

EuroQuest LLC. does not incur the cost of sales tax from vendors located in Alaska, Delaware, Montana, New Hampshire and Oregon as these states do not impose a sales tax. Also, certain jurisdictions impose a hotel occupancy tax or other type of transaction tax upon the renting of a hotel room, an automobile, etc. The type of tax charged by the vendor will vary by service and location.

These fees cover the costs incurred by EuroQuest LLC. in servicing your travel reservation.

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. EuroQuest LLC. urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov.

4.      You agree that in the event of a claim, EuroQuest LLC.s liability to you is limited to the higher of (a) $1,000.00 and (b) twice the value of the booking made with EuroQuest LLC.

5.      If EuroQuest LLC. takes any action against you to enforce its rights under these booking terms, it will be entitled to recover from you, and you agree to pay, all reasonable and necessary attorneys fees and any other costs of litigation, in addition to any other relief, at law or in equity, to which EuroQuest LLC. may be entitled.

6.      If any provision hereof is held invalid, the balance will remain effective, and to the extent feasible the offending provision will be restated to give effect to its stated intent.

APPLICABLE LAW

By visiting EuroQuest LLC, you agree that the laws of the state of New Jersey, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and EuroQuest LLC or its affiliates.

DISPUTES

We participate in the Better Business Bureau's BBBOnLine Program. This means that we have committed to cooperating with BBB efforts to resolve disputes that may arise under this contract. Upon your request, we will agree to participate in a BBB dispute resolution process to resolve these disputes. There are limits as to the kinds of claims that the BBB will handle -- call the BBB for more information.  Other than for those disputes resolved through the BBB dispute resolution process, you consent to exclusive jurisdiction and venue in the courts of New Jersey.

Any dispute relating in any way to your visit to EuroQuest LLC or to products you purchase through EuroQuest LLC consumer web sites not resolved by the BBB resolution process shall be submitted to confidential arbitration in Jersey City, New Jersey, except that, to the extent you have in any manner violated or threatened to violate EuroQuest LLC's intellectual property rights, EuroQuest LLC may seek injunctive or other appropriate relief in any state or federal court in the state of New Jersey, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
